Workshop: “Directions and Recommendations for Legislation on the Issuance of Administrative Decisions in Vietnam”
On 22 June 2026, VNU University of Law held a workshop titled “Directions and Recommendations for Legislation on the Issuance of Administrative Decisions in Vietnam.” The workshop drew a large number of experts, scholars and administrators working in administrative law.
Guests attending the workshop included a representative from the Department of Criminal and Administrative Law and Management of Administrative Violations, Ministry of Justice; Dr. Nguyen Van Thanh, former Deputy Inspector General of the Government Inspectorate; Dr. Tran Nho Thin, former Editor-in-Chief of the Democracy and Law Journal; Dr. Nguyen Thi Kim Thoa, former Director General of the Department of Criminal and Administrative Law, Ministry of Justice; Dr. Nguyen Quoc Van, former Director of the Institute of Inspection Strategy and Science, Government Inspectorate; Dr. Nguyen Van Nam, Deputy Director of the Court Academy; Mr. Pham Quang Huy of the Ministry of Finance; Assoc. Prof. Dr. Doan Thi To Uyen, Head of the Faculty of State and Administrative Law at Hanoi Law University; along with a number of other experts, scholars and practitioners.
From VNU University of Law, attendees included Assoc. Prof. Dr. Nguyen Hoang Anh, Vice Rector; Prof. Dr. Pham Hong Thai, former Dean of the School of Law (now VNU University of Law); Assoc. Prof. Dr. Dang Minh Tuan, Head of the Faculty of Constitutional and Administrative Law; Prof. Dr. Nguyen Dang Dung, former Vice Dean of the School of Law (now VNU University of Law); and Assoc. Prof. Dr. Bui Tien Dat.
In his opening remarks, Assoc. Prof. Dr. Nguyen Hoang Anh spoke about the need for a unified, modern legal framework governing administrative decisions. As Vietnam works to build a socialist rule-of-law state, he said, improving the process for issuing administrative decisions would not only make state governance more effective but also help protect the lawful rights and interests of individuals and organizations.
At the opening session, a representative of the Department of Criminal and Administrative Law and Management of Administrative Violations (Ministry of Justice) presented a paper outlining the background, requirements and key issues on which comments were sought for the draft decree. The workshop was organized into two sessions addressing theoretical and topical issues:
Session 1 focused on the theoretical background of administrative decisions and core principles such as procedural fairness, transparency and accountability in issuing administrative decisions.
Session 2 discussed issues of authority, the handling of decisions after issuance, and oversight mechanisms in the context of digital transformation, including decisions involving artificial intelligence (AI) and automated systems.
Outcomes aimed at policy recommendations. The workshop went beyond academic debate: its full results will be compiled by the organizing committee into a policy recommendation report, to be sent to the Ministry of Justice, as the agency in charge of drafting the decree, and to other relevant agencies and organizations.
The report is intended to provide a scientific and practical basis for improving the draft Decree on Procedures for Issuing Administrative Decisions. It reflects the University’s active role in policy advisory work and its academic contribution to major national issues.
